Australian Securities & Investments Commission (ASIC) has permanently banned financial adviser Donald James Cuthbertson from providing any financial services, performing any function involved in the carrying on of a financial services business and controlling an entity that carries on a financial services business.
ASIC also cancelled the Australian financial services (AFS) licence of Cuthbertson's company, Sydney-based Professional Wealth Management Services Pty Ltd (PWMS), with a condition that the external dispute resolution and arrangements for compensating clients remain in place for 12 months.
Cuthbertson is a director of three companies; PWMS, Professional Wealth Management Pty Ltd (PWM) and Professional Wealth Investments Pty Ltd.
ASIC's concerns arose from Mr Cuthbertson's conduct regarding:

PWMS's AFS licence was cancelled based on the findings made regarding Mr Cuthbertson, that PWMS:
Cuthbertson and PWMS have the right to appeal to the Administrative Appeals Tribunal for a review of ASIC's decision.
Cuthbertson's banning is recorded on ASIC's banned and disqualified register.
PWMS is an Australian financial services business based in Sydney which has held AFS licence no. 468125 since 11 March 2015.
Cuthbertson became a director of PWMS on 29 July 2014 and has been the key person on the licence since 11 March 2015.
Cuthbertson was an authorised representative of PWMS from July 2015 to 28 September 2022 and from 9 December 2022 to present.
